TERMS & CONDITIONS

LAST UPDATED AUGUST 2026

1. Overtime premiums apply to any work that starts before 7:00 AM, after 3:00 PM or after 8 hours per day, and on weekends and holidays. Overtime premiums will apply to counterweight trucks/drivers onsite for all time exceeding 8 hours.

2. Unless otherwise specified, equipment and personnel will be billed at a minimum of 8 hours per day.

3. Crane hourly rate will be billed portal to portal.

4. Quotes do not include any applicable federal, state, property and local taxes.  Any applicable taxes will be the responsibility of the customer.
5. If applicable, Site Specific will be charged with a 3 hour minimum at $95.00 per hour/per man, portal to portal.
6. If applicable, Per Diem is based per man/per day (price on request).
7. Crew Travel is $85.00/hour/man and the Crew Truck is $165.00/day.
8. Fuel Surcharge of 12% will be applied to the total invoice, when fuel is supplied by Tilghman Crane & Transport.
9. All elevated work, above six foot, shall be performed and executed in accordance with 29cfr 1926 OSHA Construction Industry Regulations & Standards, more specific subpart M-Fall Protection (1926.500-1926.503).
10. Client must ensure free and easy access to the site for hoisting operations at no cost to Tilghman Crane & Transport.
11. If applicable, Client is responsible to provide all necessary matting for equipment.
12. We are not responsible for any damage caused to underground utilities.
13. The Customer is responsible for providing suitable ground conditions and all necessary access and clearance needed to load, offload, build, tear down, and service the 
machines.  If any power lines are on, near, or adjacent to jobsite, a site visit by a Tilghman Crane & Transport representative is required prior to job start date.
14. If the job is not completed in the specified hours due to circumstances beyond Tilghman Crane & Transports control, including weather delays, the equipment and labor will 
be charged at the applicable hourly rates.
15. Equipment that is requested to be delivered prior to the job start date will be charged a minimum of 8 hours.
16. Cranes that can not be returned to the yard during legal daylight hours per DOT regulations will be charged a minimum of 4 hours for the post job return.
17. If a Supervisor is requested, required or needed, the rate is $130.00/hour.
18. Any legal fees (attorney or court) that arise due to nonpayment for work performed by Tilghman Crane & Transport will be the sole responsibility of the customer.  All invoicing that is sent off for pre-lien and/or for lien will accrue 15% interest per month beyond payment terms on the balance.  This interest charge is in addition to any legal fees Tilghman Crane & Transport incurs for all liens, suits, court costs, attorney fees, etc. due to nonpayment.
19. The rates quoted in this proposal are considered private and confidential.  They may not be disclosed or discussed with others without prior consent by TCT.
20. Unless otherwise specified, quotes are only good for 15 days.
21. Force Majeure - Notwithstanding anything to the contrary herein, neit
her Party shall be liable for circumstances or events not within the reasonable control of such Party,  including, but not limited to, fire, flood, storm, act, or omission of Government authority, labor dispute, war, natural disaster, and acts of God.
22. Credit Card payments are subject to a 5% processing fee at the time of authorization.
23. If applicable, Texas Personal Property Tax (TPP) will be the responsibility of the client, Notwithstanding any of the foregong federal, state and local transaction privilege, personal property taxes and similar taxes and equipment rates.
24. If the Customer elects not to use a Tilghman Crane & Transport qualified Rigger and certified rigging, the Customer will be held responsible for any and all delays/liabilities due to inadequate or defective rigging and/or unqualified riggers directing the TCT Crane Operator.
25. Customer understands and acknowledges that this is an estimate of proposed work only based on information provided by the customer or customers representative. The actual invoice for actual work performed may be more or less at completion of the job.
26. Customer acknowledges and agrees that in the event Tilghman Crane and Transport’s invoice to Customer is NOT paid in full ten days from the terms agreed upon and shown on the invoice,  a monthly administrative fee of $50 will be added to the balance of this invoice and late fees in the amount of 2% of the total of the subject invoice shall also be due and payable monthly until the invoice is paid in full.

 

Exclusions:
1. Unless otherwise stated in the inclusions, the quote above excludes 3D lift plans, soil testing, soil improvements, soil alterations, special matting, special rigging, spreader bars, orientations and/or site specific, drug tests, background checks, and any other site prerequisites.


Items to be supplied by client:
1. Certification(s) for any lifting hardware and lugs, their placement or any welds attached to the item to be lifted.
2. Customer to supply lifting lugs/lifting points.
